Q. What is Occupational Health & Safety (OHS) Compliance?

A. OHS compliance is where you as a Person conducting a business or undertaking must ensure that you meet all Safety legislation requirements. This begins at the Work health and safety act, and depending on your industry and specific trade activity, meet the different relevant sections of the Work Health and Safety Regulations and the Codes of practice for your industry. Ensuring that your business complies 100% with OHS Legislation is mandatory and becomes tiresome, frustrating and confusing. CASSA takes the guess work out, and creates specific OHS plans tailored to your specific business.


Q. Why Do I, as a business owner / employer need to be OHS compliant?

Q. What happens if my business is not OHS compliant?

A. You and your business would be open to civil and criminal litigation if an accident or incident occurred to one of your employees, or the broader public. Q. How do I become OHS compliant?

A. There are many ways you and your business can become OHS compliant;

• Employ somebody full time to continually update and follow up on OHS issues for your business.
This is the most expensive option usually upwards of $70,000 a year.
• Pay an OHS consultant thousands of dollars to create a one off plan only to have to decipher
the information and implement the plan yourself.
• Research all OHS legislation and put a plan together your self. This will be a very time
consuming exercise and with no guarantee that it will be correct as current OHS
legislation can get confusing and frustrating to understand.
• Finally, the most cost effective and easiest way is to engage CASSA to implement a tailored,
easy to understand OHS plan and analyse training needs for your business operations.


Q. As an employer I have researched OHS in the past, but legislation and regulations always change, and nobody tells me about these changes. Where do I find these changes?

A. Legislation, regulations and code of practices change all the time, this is due to certain incidents around the country, WHS in each state will investigate incidents and assess where the “system” has failed. Once these failures in the system are identified, measures will be put in place to help prevent incidents re-occurring. The way in which this is delivered is through changes to legislation, regs, code of practices and safety alerts. Unfortunately it is up to the employer to keep up with these continuing changes. Larger companies have the resources to employ OHS officers, which constantly monitor these changes. Q. I am contracted to a Principle Contractor; they tell me what I need to start OHS wise. Why do I need CASSA if I am still winning tenders?

A. Principle contractors have various civil cases each year. However due to the vast resources and the comprehensive OHS management systems the companies have in place, it makes it very difficult to get a prosecution. If a case can’t be made against the principle contractor, the focus will then fall on the employing subcontractor. So you can see that having your own OHS management procedures and plans in place will drastically minimise the risk of criminal and civil litigation against you, the sub-contractor, whilst at the same time proving yourself more appealing to the principle contractors - simply by maintaining 100% compliance.


Q) What if I already have an Occupational Health & Safety Plan?

A. That’s GREAT! It shows that you are already aware of the importance of OHS. CASSA will integrate your existing plan and make any updates and required changes to ensure that you are 100% compliant with current State and Federal Safety standards. As well as just an OHS Plan, which is only a small part of being OHS compliant, CASSA will ensure that you have a comprehensive OHS Management system in place that can easily be followed and implemented, and that is recognised by governing bodies.


Q) What is OHS Consultation?

A. As a Person conducting a business or undertaking, you are required by law to consult with your workers on matters that affect their Health & Safety at work. This involves meeting with them regularly to share and discuss OHS information and issues at your place of work. This enables employers and employees to work together to maintain a safe and healthy workplace.


Q) What is Risk Management?

A. As an employer, you have an obligation to identify, assess and manage ALL foreseeable hazards in your workplace, in accordance with the Risk Management Code of Practice. This is an important & vital component in maintaining 100% OHS compliance. CASSA assists in this complex process and provides you with the vehicle to comply with all relevant legislation.


Q) Who is responsible for Risk Management?

A. The responsibility for risk management is always an employer’s responsibility. Even if you delegate this responsibility to a Manager, Supervisor, or a 3rd party, the obligation and responsibility falls on the employer. Again, you can see what a valuable asset the CASSA system is, in assisting you to maintain your 100% compliance.


Q. What is a Notifiable Incident?

A. There is a set criterion that identifies all Incidents that must be notified to governing OHS bodies within 48hrs. The Notifiable Incident criteria forms part of the CASSA OHS plan and is explained in detail when you become a client of CASSA.


Q. What do I do if an injury or incident happens at my work?

A. As an employer you must ensure that you have Rehabilitation and Return to Work procedures in place. An incident investigation must also take place. If it is a Notifiable Incident you must follow the correct procedures and notify the governing OHS body. There are many things that need to be looked at when an injury happens at work. Depending on the severity, it could be a simple first aid injury where internal procedures are looked at and potentially changed, or it might be a notifiable incident where an in-depth investigation by a Governing OHS body may take place, which may result in potential prosecution.

If you are a CASSA client, CASSA will assist in the management and implementation of all procedures and actions that are required. This includes rehabilitation and return to work procedures if necessary.


Q. Does CASSA cover all aspects of OHS Compliance?
